It is used particularly frequently when setting up a <strong>new office<\/strong> in the USA or <strong>transferring<\/strong> staff to an <strong>existing US company<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>2. alternative to the e-visa<\/strong><\/h3>\n\n<p>The L-1 visa is also an option if the <strong>requirements for an e-visa<\/strong> &#8211; for example in terms of nationality, investment amount or trading volume &#8211;<strong> cannot be met<\/strong>. In these cases, the L-1 visa is a frequently used alternative. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>3. non-profit organizations<\/strong><\/h3>\n\n<p>Unlike the e-visa, the L-1 visa is also open to <strong>non-profit organizations <\/strong>, which can therefore also settle in the USA.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Validity and extension of the L-1 visa<\/strong><\/h2>\n\n<h3 class=\"wp-block-heading\"><strong>Initial issue and renewal options<\/strong><\/h3>\n\n<p>If the visa is applied for to establish a <strong>new office<\/strong> in the USA, the initial period of validity is <strong>one year<\/strong>. For US companies <g id=\"gid_2\">already in business<\/g>, the stay can initially be approved for up to<g id=\"gid_3\"> three years<\/g>. Subsequent<strong> extensions of two years<\/strong> are possible.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Maximum length of stay<\/strong><\/h3>\n\n<p>Holders of an<strong> L-1A visa <\/strong>may stay in the USA for a maximum of<strong> seven years<\/strong>. For<g id=\"gid_2\"> L-1B visa holders <\/g>, the maximum duration is <g id=\"gid_3\">five years<\/g>. The decisive factor here is the actual<g id=\"gid_4\"> physical presence<\/g> in the USA, not the duration of the visa holder&#8217;s stay. Exceptions may apply for commuters who move between locations at home and abroad.   <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Connection with the petition<\/strong><\/h3>\n\n<p>The visa is always linked to a<strong> petition<\/strong>. For example, if a visa is granted for five years but the petition is only approved for three years, the employee may only stay in the USA<g id=\"gid_1\"> for three years<\/g>. This can be a <strong>parent-subsidiary structure<\/strong>, the German and the US company can <strong>be sister companies<\/strong> or one can be the <strong>branch <\/strong>of the other.   <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>2. continuation of the home company<\/strong><\/h3>\n\n<p>The<strong> German <\/strong>company must <strong>continue<\/strong> its business activities during the employee&#8217;s posting. A temporary suspension or complete shutdown of operations excludes the use of the L-1 visa. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>3. proof of office for newly established companies<\/strong><\/h3>\n\n<p>When establishing a new office in the USA, a <strong>rental agreement for suitable business premises<\/strong> must be submitted at the time of the petition. If this has not yet been concluded, the petition is not complete and <g id=\"gid_1\">cannot <\/g>be <g id=\"gid_1\">approved <\/g>. Subsequent submission of a document that does not exist at this time is not possible &#8211; a <strong>new petition <\/strong>would have to be submitted.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Requirements for the seconded person<\/strong><\/h2>\n\n<h3 class=\"wp-block-heading\"><strong>1. professional experience and employment<\/strong><\/h3>\n\n<p>The applicant must have worked full-time for the German company for at least<strong> one year<\/strong> within the last<strong> three years<\/strong> <strong>before submitting the application<\/strong>. Part-time or interrupted employment relationships <strong>are not sufficient<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>2. leading position<\/strong><\/h3>\n\n<p>A managerial position exists if the employee <strong>makes key company decisions<\/strong>, manages a department, supervises other managers or has a say in personnel matters.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>3. specialized knowledge<\/strong><\/h3>\n\n<p>Specialized knowledge within the meaning of the L-1B visa refers to <strong>company-specific knowledge<\/strong> that <strong>is<\/strong> <strong>essential<\/strong> for the work performed in the USA and is not available on the US labor market. This includes knowledge of internal processes, products or services. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>4th position in the USA<\/strong><\/h3>\n\n<p>The job in the USA must also be either a<strong> management position<\/strong> or one <strong>with specialist knowledge <\/strong>. The exact function <strong>does not have to be identical<\/strong> to the previous one &#8211; a change between management and specialist function is possible. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The petition and the application procedure<\/strong><\/h2>\n\n<p>Before applying for a visa, the US company must submit a<strong> petition to the USCIS <\/strong>. This must fulfill all requirements and provide evidence &#8211; in particular regarding the company structure, employment in the home company and activities in the USA. <\/p>\n\n<p>All actual requirements must be met at <strong>the time of application <\/strong>. If only documents are missing, these can be submitted subsequently. However, if the<strong> requirements themselves are not met <\/strong>(e.g. missing rental agreement, required business license, etc.), this cannot be rectified retrospectively &#8211; a new petition would be required.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Blanket petition: L-1 visa without case-by-case examination<\/strong><\/h2>\n\n<p><strong>Requirements for the Blanket Petition:<\/strong><\/p>\n\n<p>Companies that regularly send employees to the USA can apply to the USCIS for a <strong>blanket petition<\/strong>. This allows future employees to apply directly to the US consulate <strong>without the need for an individual petition<\/strong>. <\/p>\n\n<p>The blanket petition is possible if the US company <strong>has been in existence for at least one year<\/strong> and also fulfills one of the following conditions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>In the<strong> last twelve months<\/strong>, at least<strong> ten L-1 visas <\/strong> were<strong> successfully applied for <\/strong>(for managers, executives or so-called &#8222;specialized knowledge professionals&#8220;).<\/li>\n\n\n\n<li>An <strong>annual turnover of at least 25 million US dollars<\/strong> was achieved.<\/li>\n\n\n\n<li>The company<strong> employs at least 1,000 people in the USA<\/strong>.<\/li>\n<\/ul>\n\n<p><strong>Important<\/strong>: Only certain professional groups are accepted for the Blanket Petition &#8211; specialist knowledge alone is not sufficient.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Family members in the L-1 procedure<\/strong><\/h2>\n\n<p>Spouses and <strong>unmarried children under the age of 21<\/strong> can enter the USA with an L-2 visa. The <strong>spouse receives a work permit<\/strong>, but the children do not. While children have the right to attend school or university, spouses may take up gainful employment \u2013 however, a work permit must be applied for from USCIS after entry. The relevant form is I-765. It is important to note that this application cannot be made at the time of visa issuance, but only after arrival in the USA. For some time now, work authorization has also been possible with the so-called Form I-94, which can (and should) be downloaded from the internet after entry. If the I-94 of the accompanying spouse contains an \u201cS\u201d in the visa category (i.e., \u201cL-2S\u201d), no separate employment authorization is required.
